    Married filing separate - deductions?
    My husband owes back taxes so we are filing separately. #1 - do we both list all our dependants, deductions, etc? Also, if we refile within 3 years as joint, we will be eligible to claim my tuition and also receive the Earned Income Credit for our kids?

    Just ONE of you can claim the dependents. You can pick who gets whom.

    You BOTH must itemize or BOTH claim the standard deduction.

    Yes, if you amend by April 15, 2010, you can then get the EIC and tuition credits and deductions.

    Each year you can choose whether to file joint or separate. The previous year has NO effect on your decision this year.
