My husband has court this Thursday for an escape charge and has been in jail for 5 months he has to go in front of the Grabd Jury is there a chance he will get out with time served? It's usually 6 months jail time for escape here in Ohio. And no, they don't just let you go with time served. The 5 months would not be enough time.

Ok, to have escaped, it means he was in jail or prison for some other charge and that time was not over yet.

3.It would be in the years here in GA, not months, so I don't think he will be going

If he was on house arrest and cut his tracking device off, then that would be a 5th degree felony escape charge as well. You don't have to be locked up in jail to be considered an escapee, Chuck. Just cutting off your tracking device is enough to charge you with escape. That's probably what her husband did. Happens all the time up here in Ohio and they just add 6 months onto your jail time after they violate your probation for escaping.

I have seen 3 years or being put back in jail for the entire full sentence for cutting off the leg device here.
