    Can a mother move out state with the son with out the father?
    I'm a father of 3 years old, never married, we lived one year on the same house, he's born in my bed on 14 hours labor.She have full custody set on court but we had an agrement that I'll custody after his 3 and more independent.Those 3 years I support both like a father, child support, day care, many deposits for the moms school, set up 2 apartments for her, giving her all the conditions to be a home mom and raise our son with everything that a mother and son needs. I mention with her that I want to have custody of my son and she told that she moving out state. My son and I are very close, since his born I never left him for more than 3 days. I was living on the street, he stays with me overnith one a week, I spent time with him almost everyday. We live in Wisconsin and she want to move to California. Can She? She have rigths to do that?

    No "agreement with her" is binding unless it was written down and part of the court agreement signed by the judge

    So what visitation do you have, you said she has custody, ( and I guess why don't you have joint ?) but what visitation do you have set by the court ?

    Now you go back in an emergancy filing, to protect your visitation by stopping her from moving the child.
