We are under contract to the US Forest Service, and they have on numerous occasions to their on detriment, have changed their mind on agreed upon work. The result is to find my company in default of the contract. There is proven intent to cause damage to my company.

You don't sue the employee - you sue the organization with whom you have a signed contract IF you can show that they have breached the contract and that the breach has caused you financial loss.
