    Eviction Procedures, my rights as a tenant.
    I was late in paying rent for August 2011... Understandably it is about business and what has to be will be. I paid all fees owed (rent and all associated late fees) three days before the eviction papers were filed in court. My question is should the attorney have been contacted and told not to file eviction papers? This is my understanding of the law, but I could be wrong. If anyone can clarify, I would greatly appreciate it.

    If you are late by one day or do anything that violates the lease eviction papers can be filed. The fact that you paid the rent may not have convinced the owner to keep you. Paying, but paying late, does not stop an eviction unless the owner wants it to stop.

    Was the notice you received a "pay or quit" of just a eviction.

    They can still evict even if you pay.
