I've been married for 20yrs and committed adultery.I am 40yrs old woman and now my husband has filled for divorce without my knowledge on the basis of cruelty and adultery.Now acc to him I have no right on the property that he bought after marriage and also no right on the property that is in joint name.He didn't allow me to study further after marriage so I am just a graduate.now I've strated working in school and my salary per mth is 5000 rupees.my husband is an nri and is earning good money.So I want to know my rights on that property and alimony although I don't want a divorce.now he wants mutual divorce but isn't ready to buy me any property.What I would like to know is that how much time is required before he can file for divorce or for mutual divorce?I would be obliged if you can ans my quaries..

You have posted before about your husband "catching" hepatitis from another woman, about health problems which have prevented you from working. Now you say he didn't allow you to study.

If you are going to protect yourself financially you need an Attorney. This could get very complicated.

My husband wants a divorce but both my kids daughter 17yrs n son 12yrs n me don't want that to happen..

Normally you can not stop a divorce, merely ignoring it and not doing nothing will leave you with nothing often.

It is time to get an attorney and find out what your rights are so your husband does not control you with threats.

Even I 'm in the same boat, due to small issues he is threating me that he 'll divorce me. I hv 6 months old son. Well I won't be leaving him anyway as I hv suffered that much 'cz of him, sply mentally and I never let my parents know anything, within 6 months after marriage he said so bad things to me I attempted for suicide as ours was love marg and it was hard for me to bleive he was saying so. I know now he is doing all these 'cz of someone's saying.Above all I hv a sis, marrying him is dropping most of my sis's proposals ( caste issue).
I doubt its only a threaten just to make me stay with his parents. But still to make my side safer I want to know all the legal sides which will help me to stop the divorce, I don't want to beg him neither leave my boy to him.

You can't stop him from divorcing you. You are probably aware that your suicide attempt would have left "your boy" without a mother. The Court will take that into consideration when custody is argued.

Dear Judy, my suicide attempt was 2 1/2 years ago not now. I decided for a baby once I was sure everything is sort out and my DH is caring about us. I never expected him to change so much by me just staying away from him for 6 months.

All that I earned in these years was spent to sort out his debts, I never took a single penny out of it. More than money the love and trust... Anyways I think its time to be serious and think over bt never to let him so. I always kept my parents and his as well out of this, bt last week he talked so rudely to my parents telling I'm mentally sick, when he used to torture me so much telling wrong things while going to office, behaving sometimes as if child, weeping for small things, getting arrogant unnecesarly. In fact husband need to take care of wife, being caring and sharp wenever necesry. Here I was taking his care acting maturely... so who is mental me or he.

I went through c section and was under bed rest, he took me to his house, I was so disturbed as my son had heart problem. He was not bothered at all. He just left us with his deaf mom and go out with friends telling planning to buy plot. Also quarelled with me to give him my gold (gv by my parents during wedding) to buy plot. I got so angry here 'm upset with my own condition and thinking about my sons health issues I don't get sleep @ night, moroever my son was so sick that time, he don't even help me at night when I had to tk care of my boy. Also v don't hv so much savings neither in a condition to borrow/loan as his job was and is at stake, and above all so much debt, sply taken for his friends... c won't I get angry. I never ever rased my voice before sply when I was working, as that time somehow v wer able to manage, bt now I can't go for work and v r having our kid to tk care of, expenses are increasing, and theirs no need to run for plot.infact it is not the right time, its time to enjoy with family and our son.After a long waite and prayers got this baby, my hubby had problems with conceiving, so much of tention. 'm I not right by asking him why he need my jwel and mony when its not the right time. Problems started from then, may be he realised he can't fool me any more... If he had behaved properly I would hv asked my father and he deffinitly helped him, bt he was rude all the way till I stayed at his home.While going back, he left me at my home didn't say anything to my parents and didn't call thereafter. I felt so hurt, (not of the fear he abundened me, bt for the love and trust v shared), was hospitalised for chest pain, if something happened to me that day 'll I be there for him to talk. My parents wer weeeping they informed his friends as his no. was not going. He didn't even called me.what all problems 'cz of him... n now telling he needs his wife and child back otherwise 'll sue my father, 'm I not a major. I can't understand what's his problem. Whenever I tried to talk about it he ignored. Now I think I can't take up... bt at the same time can't leave him for my boy. Hope things 'll get settled soon.
