    Will he get out?
    Hello... Well my husband was violated by his probation officer Sep 18,2011.. Went to court Sep 21,2011.. The judge said their waiting for the report from the probation officer. So his next court date is Oct 25,2011.. So he's been in jail since. Everyone that came in to see his p.o was violated and put in jail. Well the officer has been transferred. So who's writing the report? And his original case is from running from the police in 2004.. Its 2011 he hasn't been in trouble. He was violated for pissing dirty.. Well not dirty.. Clean.. But not clean enough! My question is there a chance he'll get out the 25th? Or is he looking at some time? Please someone answer...

    You either test clean or dirty - there's no in between. Which one was he?

    The report will be written either by the new PO assigned to him OR by the "old" PO's supervisor.

    If he's been held since September 18 it would appear he's not going to be cut loose.

    Only the Judge knows 100% and, of course, that happens when the hearing is held.

    On the 21st he had video court...

    It is not uncommon to set in jail 30 to 60 days waiting for the final probation violation hearing, Locally here you would not have even had the first hearing. So he may sit for a while still.

    Again, his urine was either dirty or clean, on probation, a little dirty is still dirty.

    I would say there is a good chance he will be put back on probation, but often the courts keep them in local lock up for a couple to a few weeks ( to teach them a lesson) before they put them back on probation. Others will get them out faster if jail space is full.

    Thanks chuck!! I really hope that's the issue... and its reinstated... and the day he was arrested his previous probation officer said that if they ask for his recommendation he'll say to reinstate his probation... he has court the 25th so... *fingers crossed*
