    How does a court prove rape?
    So right away at about three in the morning she said she was raped at about three the next day before she went to the hospital then there is a few pepole that is saying she got raped three times why wouldn't she leave after the first time? And if that is proven how in the world would nt she leave plus there was drugs and achool involed in the whole thing a lot it was July forth and she was taking out of my bed by my wife and my wife said shed be back and then she was in my bed again

    There are two components to rape, first is the sex act, second is consent. If the victim was under the influence of drug and/or alcohol then she may not have been competent to consent.

    So she is confused or one of you is lying. The details about how she agreed to have sex is more the issue that needs to be dealt with.

    At this point, don't make any statements to anyone, including the police till you hire an attorney

    Thanks and there was a lot of achol and drugs but my wife took her out of my bed and sais she would be right back but it was her in my bed a second time

    The court isn't expected to prove a thing. That's the prosecutor's job.

    And to make sure the prosecutor can't do that, your defense attorney needs to sow plenty of reasonable doubt seeds.

    Have you discussed these questions with your attorney?

    So a girl appeared in your bed and you didn't look a gift horse in the mouth and had sex with her? Is that your story? Because if it is, a jury is not going to take kindly to it.

    Have you been arrested? Charged? Do you have an attorney? You better get one, because I'm assuming here they can prove the sex act. So the only issue is consent.
