My question: Can a child be adopted with biological parent paying child support? Maybe there different types of adoption-just trying to see whether having parental rights relinquished or adoption would be best for me and my child. I certainly WANT him to pay child support. He wanted her,now he is going to pay for her. This is what I would like to do if possible- My parents would like to adopt my child and I'm okay with that. I still want father of child to pay child support and go on supervised visits. I'm expecting a child in January and looking for the best way to go about doing things in relation to the child's father. Here is a synapsis of my situation- 1. He is in love with his daughter(yes I said, "in love" 2. He was cool in the beginning about having the child and like being a father 3. Later in his words, "dont want you or it and I want distance." 4. I gave him just that. 5. Recently he's been in contact with me via only text asking about my health and well being, want to come see me @ midnight. 6. Were 40 years old. 7. I don't have time for games, my unborn child deserves the best for which I will give as a parent, mother, a woman. 8. God is still good!

My answer: no.

If the child is adopted, the father will be, legally speaking, no longer the child's father. And if that becomes the case, he will have no duty to pay child support.

There may be an unusual statute providing for it in whichever state where you are located, but I don't think so.

By the way, it's "synopsis", not "synapsis". Not a common error, but not a commonly used word either. :)

First, adoption legally severs the ties between child and parent. So, if your parents adopt, BOTH you and the father would would lose any rights AND responsibilities for the child. This means support would end.

If you want your parents to care for your child, you can give them temporary guardianship. This would not remove his support obligation. However, he could fight it. He could ask for custody. If he does, it is likely he would get custody over the child's grandparents.

Agree, NO, once the child is adopted, he would not owe any child support, ( and of course he would have to agree to the adoption and not fight it in court..

Also why is the child better with your parents, and why are you not wanting to keep your own child ?

Thank you and I'm glad to know. Actually I will be caring for my own child.. not a problem. My father is prior military and there are certain benefits that come with adopting but again I will have my own child and supporting her. I hate that I involved myself with a person like this but of course I found out one month after becoming pregnant and was truly devastated and couldn't forgive myself. Now I'm in the processs of forgiving myself and just knowing the power of forgiving. My parents and I are on one accord on trying to figure the best thing. But franklyI don't know what the father will do because he is a liar, cheat and a thief. Anyone that sleeps with his own daughter has a serious problem that I could never fix but I can do all I can to protect what is mine. Adoption may not be the route but I do want my child to know her father and to have supervised visits only. I guess he can object to supervised visits? If so, so be it. My due date is approachinhg and I've spent money for pregnancy and preparation. Well can I ask not only for child support but for assistance from him from what I've already paid.. crib, clothes, medical? I hope so.

No, you can ask for child support, such support will be awarded based on income, not what you have already paid.

Maybe I've misunderstood. But I thought you already had a child by this person and were expecting another by a different father. On reading your last post and re-reading the initial post, it now appears that he has a daughter of his own who you claim he's sleeping with (what proof do you have of that?) plus he got you pregnant and you are expecting his child. Is that correct?

That is correct. I do not have any children, however I am pregnant by him now (due in Jan). He has a daughter that he has been sleeping with for years. She is now 20 years old, I will call her Tasha. My proof are his emails, photos of his daughter naked and my own testimony of the behavior I've seen. He said things like, "Take pictures of yourself getting out of the shower and please get a picture of that sweet spot. "Do not be an idiot and tell your family about our "relations". Now his daughter has made passes at me (she's a lesbian), he would touch her in ways I thought were strange at the time. In addition, he has a six year old boy in which his mother made a claim to CPS about his daddy poking his penis. Well the father and Tasha were brought in for questioning but it didn't go anywhere. But back to his daughter, Tasha. I contacted her mother via the internet and she was devastated and so hurt when I presented evidence to her. She filed a police report. Case is closed because Tasha is lying and will not reveal that she and father are sexually involved and have been for years. You know Scott I found out so much after seeking God and doing some research on my own. In addition, one of his emails is from a lady and she says, " Hi, I'm like you, I do not like clubs much. But I like movies and listening to music. Here is my daughter. Do you think she is cute?" (color picture of daughter just below the email). She is young and appears to be around age 15. Tasha's mother stated to me that she spoke to an ex girlfriend of his after I gave her evidence. The ex girlfriend stated that she knows about it but will not go the police because she is afraid to. Recently he's been wanting me to send pics of myself while I'm pregnant. Yeah right! Sometimes I feel he's getting away with so much without consequences...
