    What is the limit for filing a bad check?
    I paid this person for carpet and then came back and said there wasn't enough on the roll and wanted me give him some more money for a different pice to finish it out.I said no just give my money back so he wrote me a check that came back. So what is the time frame for filing against him?

    YOu posted in the Criminal Law forum, so may I assume you are asking about the statue of limitations for criminal prosecution?

    Depends on what state/country you are in.

    I live in the state of North Carolina. I Wrote him a letter telling him he had 15 days to take of the bad check.

    For criminal prosecution, two years, unless it constitutes a felony, in which case there is no SOL.

    If you want to sue him in a civil action, it would be three years. If it constitues fraud, the SOL runs from the time of discvoery.
