    Can someone file for back child support after the child is over 40 years old? There was an order when the divorce was final in 1975 for the father to pay 800 a month. He paid what he could, it wasn't 800. Can the mother go back after that many years and sue the father for the back child support? There is no proof that anything was paid. The back has no record after this many years.

    If there WAS an order and the payments were not made, then yes the recipient of the support can go to court to collect on the arrears.

    The person who was awarded the support can certainly file BUT I see a HUGE problem with the burden of proof. If nothing else the person who files (the Petitioner) will have to explain why she waited so long to attempt to collect.
