    Is written notice of intent to vacate the premises required when leaving an oral contract? A friend is having some issues with her former friend/landlord who is threatening to take her to small claims court because she didn't give her a 30-day notice. Without going into the nitty gritty - does she have a leg to stand on?

    Hello as:

    30 day notice is required. If there's a controversy, it would have been better had it been written, cause she's not going to be able to prove she gave it.

    Is this a month to month lease? If this is a month to month lease, the tenant must give a 30 day notice, which includes a full rental period.
