Is there a child custody order in effect?
You can only get in trouble if you violate one of those.
And, by the way, "The father and I are not married." would be the correct way to write that last piece of information.
If there are no court orders involving custody and visitation in place, then you have equal rights to the child.
However, if you hide the child from his other legal parent, you can be prosecuted for parental kidnapping.
If there are no court orders, the father can then go to court to enforce his rights. Your removing the child may not sit well with the court and result in them awarding custody to the father.
If you want to explain the circumstances a bit more we may be able to help further.
