    OPT to H1-B Tax Filing
    Hello all,

    I have a questions about filing my taxes as well - I was on OPT from Jan 1 - July 31 , 2006and on H1 from October onwards. I moved to Texas from Virginia on October 1, '06 and living here since than.

    Questions:

    1. I got 2 W2's. Do I have to file them separately -
    - one for OPT & second for H1? (Will I get all my taxes back paid when I was on OPT?)
    - one for VA & second for TX?
    2. What forms do I fill-in, if my salary before October 1st was under 52k(OPT) and after October 1st is more than 52k(H1)?

    1) No. Add the figures together and file ONE federal return. You need only file one state return (for Virginia), as Texas has NO state income tax. You will file as a part-year resident for Virginia.

    2) File as a non-resident alien, filing Form 1040NR. You will want to claim moving expenses (Form 3903). Don't forget that you must file Form 8843 one last time.
