    Eviction of person not on the lease in a VA rental.
    I have a rental property in Alexandria, VA that the tenant has permitted someone not on the lease to occupy the house. Will the police remove a person from a rental residence that is not on the lease? The person on the lease has given up the property but this other person refuses to leave. Can you help me?

    Was there a sublet option in the lease contract? The police will not throw out someone unless the law is followed. You may start proceedings against the lease holder and get them out that way. Mostly it depends on where you live as local laws differ around the country.

    If there is a sublet option then that is who you chase after.

    Did your tenant's lease expire yet? As Califdad asked was there a sublet option or a prohibition for subletting?

    Most likely this person can prove residency. Therefore, he has to be evicted according to local procedure. The local housing court can explain that process to you.
