    Retroactive Child Support in NY
    I heard NY doesn't allow for clawbacks... In other words can an exwife go after the ex husband for support that she let go from June of 2010 till now? Each parent had a child, the oldest (living with father) moved in with her boy friend (still keeping a room at the fathers and father still paying auto ins) And ex wife didn't go after any support till now (14 months after the fact), after ex husband had her served with support papers because now the son has opted to move with the dad. And still falls under the 21 emancipation guideline.

    NYS does allow for retroactive awards at the discretion of the court. But generally its based on the date of filing. The custodial parent does have to apply for retroactive support.
