My boyfriend wants to adopt my son
My boyfriend wants to adopt my son. How do we go about doing this? My sons "sperm donor" hasn't been in his life since aug 2008. He can not see my son says the courts because he has child endangerment charges for holding a knife to my son the night I left him.. We just want this all behind us. My son deserves better and my boyfriend has been raising him since he was 1 that is all he knows.. I just want to know what my steps should be.

Since this isn't in the legal forum (which it probably should be for the best answers) I'm going to give you the scenario of what my friend had to go through.

The biological father wasn't in her sons life either, but she still had to get him to sign over his parental rights, that was along court deal in it's self, but the boyfriend could not adopt her son until they had been legally married for one year. I do think it will depend on where you live, so if you included that info it might help.

Moved from adoption to family law.

In most states, you MUST be married at least a year to even consider step-parent adoption.

Also, having the child endangerment charges will help you, but you will still either need to get his consent for the adoption or present proof in court that he is a clear and present danger to the child and should have his rights severed without his permission.

I suggest consulting a family law lawyer in your area. Adoption CAN be done without a lawyer, but setting a bone can be done without a doctor as well. I don't recommend either.
