    Can a payday loan company go to small claims court before going to collections?

    If the payday loan is deliniquent (it is their money after all), then yes, they can go to small claims court in order to obtain a judgment to collect the loan.

    But do they have to send it to collections first? I am making payments on 2, one is down to $297, the other is at $395, but they're both threatening court, I have yet to hear from any collections, they call directly from there store. Thank you.
