    Money taken from my checking account without notification
    I had a credit card a few years ago that went into collections. I attempted a few times to make payment arrangements with this company but the company always refused my offer. After at least a year going by I finally received papers stating that the credit card company turned the account over to an attorney who filed a claim in my local court district. I spoke to the attorney who said I would have to pay an amount that I felt was more than I should have or even could have paid at that time. I have recently received more papers stating this will go to court and I will receive a court date at the courts discretion. However, this morning I discovered that this credit card company had taken over 1200.00 out of my checking account. I had no notification of this happening, I was waiting to go to court over it. I have spoken to the credit card company who says this dosen't sound right and that I should have received something stating this would occur. I have been told to contact the fraud department Monday morning about this situation. The credit card company also informed me that the attorney handling the case should have accepted my offer when I made it but however he refused. I have three small children and have worried about this all day so if anyone could give me any information as to whether this was done legally or not I would really apprectiate it. Thanks.

    Call your bank. There are opnly two ways this could have happened, either by authorized withdrawl(e.g. ACH, Debit card, Echeck etc) or by a court order. If there was no court order and the bank says it was an authorized withdrawl, you can dispute this and the bank will give you provisional credit. You will have to sign an afidavit to attest the fact that you did not give permission.
