What is the effect of Public Law 111-22 (May 20, 2009) on length of notice to tenants to vacate after foreclosure
Prior to passage, any lease in effect at the time of foreclosure was voided. This meant that the new owners could terminate tenancy with minimal notice.
Under the terms of the law, which are pretty clear, an existing lease needs to be honored unless the new honor plans to occupy the property. In that case, the tenant has to be given 90 days notice to vacate.
