    Like in most jurisdictions, one of the determining factors whether a crime is a misdemeanor rather than a felony is the amount or value of the property stolen. Additional factors such as previous criminal record, using devices to thwart loss prevention methods, working as part of a shoplifting ring, stealing firearms, or stealing certain metals can all bump the crime automatically to felony status.

    In Texas, generally speaking - without other mitigating factors as mentioned above, amounts up to $1,500 are misdemeanors rated Class A to Class C.

    Amounts $1500 up to $20000 are considered a State jail felony; $20k - $100k is third degree; $100k to $200k is second degree; $200k or more is first degree with a maximum of 99 years in state prison.

    99 years in prison for shoplifting? Now I know Texas is worse then tough on criminals. I know they have the anti loitering laws that are tough as well. Can't linger outside a store for more than a few minutes or the cops will come over and quiz you as to why you are there.
