Truck window broken by lawn company while at work.
I parked my truck at work last week and when I got off at the end of the day, I found the back window of my truck had been shattered from a rock from the lawn mowing company. When I contacted the owner he informed me that he would pay for at least half. Obviously, I don't feel that by parking my car I was negligent in any way, so I think that they should pay for the entire balance. How would you proceed?

First off explain it to the company so they can make it right. If they refuse then take them to small claims court for the entire amount. Also report them to both the company that they are servicing and to the better business bureau after all the facts are in.

Can you explain how you "found" this? Did the workers leave a note?

Were you parked legally? Do you have glass coverage on your car insurance?

    Hello c:

I'd take their offer. If you sue them, you'll lose because you have no PROOF. You didn't see them do it, and unless you can bring a witness who did, you'll lose.

I was parked legally, no doubt about that. The parking lot is surrounded by company property. I found out when I walked out and the window was shattered, and there were pieces of gravel on my tonneau cover of my truck. There were no witnesses when it actually happened. Furthermore, this is the 3rd employee vehicle this year that has had a window knocked out by the lawn mowers. I talked with the other two people and they were paid in full by the company. This window costs about 400 to replace and I just don't think I should have to pay 200 bucks to essentially park my car. I know that half is better than nothing... but hoping to get it all paid for. Thanks for your help.

Well if you have previous history, you may win. But it will be close unless have a witness. The fact that they made you an offer may help. I would go back to them and tell them you reimbursed other employees, why are you not getting full reimbursement?

The lawn company should have liability insurance to cover the damage their equipment did. Ask the owner of the lawn service to put you in touch with his insurance company.
