You don't unless you have power of attorney.
Ok, the power of attorney that I have is for her hospital and medical decisions, can I use that one?
No. That has nothing to do with her property or estate. There is nothing you can do unless you have control of her legal affairs and property. After she passes away, if there is a will that specifies what happens to the property, then it will be handled according to her wishes. If there is no will, then the estate will be probated and distributed according to the inheritance laws of your state.
I have to ask though... if your mom was fin with him being there for ten years, why are you so anxious to get him out?
Well, I am on the deed to the house, I have never been OK with him living there, he sexually molested my son 10 years ago, and we moved out.My mother has stayed with him.
If you are an owner, you can evict him. You, of course must properly notify him.
We tried prosecuting him, but all I have is a case number, it was his word against mine.
Police never arrested him.
