The other day I was stopped at a stop sign. There was scrub in the way so I inched forward... it was safe to go.. next thing you know I'm looking in my passanger blind stop to see this guy hitting me... my car was basically out of the intersection and he plowed into the right back side of my car... I didn't think I was at fault so I called the police and she gave me a ticket for failure to yield when she didn't even get out of her car t takepictures or measurements! I have reason to believe he was speeding and there was no witnesses. Should I fight this?

What type of intersection was it? 4 way stop or other controlled type of intersection ?

No it wasn't.. If it was SAFE, you wouldn't have gotten hit.

It's your responsibility to make sure the way is clear. You didn't. I know you THINK you did, but the fact that you got hit indicates that you didn't. It can't be clearer. That's why the cop didn't have to get out of her car.

If this was a traffic light, by law, you are not suppose to enter the interesection until it is clear to travel all the way though.
*** Ie, it is illegal to "inch" you way into it. ** it is done every day, I do it every day, it is illegal. If you are caught in the middle of the intercession after the light turns red ( green for the other side) you are in the wrong and guilty of possible serveral violations depending on your state,

Now if you had entered the intersection and was stopped, you were in the wrong but not moving what so ever, then both of you could be at fault, but if you were moving into the intersection, yes you would get the ticket.

So there is a two choice thing here
1. you are at fault but so is the other person
2. you are at fault, and legally the other one is not.

Traffic officers normaly do not take photos, I did 100's of wrecks and only took a photo in about 2 cases.
The officer draws a rough drawing of the area and movement of the car.
They take statements from both people and that is all they do.

If your story you told us , was the same as you told the officer, basically you confessed to being guilty
