Does anyone know what the statute of limitations is in Ontario Small Claims Court:
Ontario's Limitations Act was amended on January 1, 2004. For most claims arising before this date the old limitation period of six years still applies. For most claims discovered after this date the limitation period is now two years.
To add onto Justice Matters response,
There is no SOL for a court.
Rather, there is an SOL on the type of thing you are suing for.
For example, unpaid credit card debt. SOL is 2 years if it happened Jan 1, 2004 or later, and 6 years if it happened Dec. 31, 2003 or earlier.
But in general, its 2 or 6 years, depends on what it is you are suing and the particulars of the case.
