    Well, yes.

    But the relief you can get from the court would not be the "impreisiment" of the offending spouse (or imprisonment either). It would be a decree of divorce.

    However, since all states now allow "no-fault" divorces, upon grounds such as irreconciliable differences, adultery as a basis for divorce is pretty-much redundant.

    Imprisonment is a punishment for a crime, not a remedy available in a civil lawsuit (the procedure by which one person sues another person in a court of law). If adultery were still a crime (I'm fairly certain it isn't anywhere, at least in the U.S.), the government (not an individual such as one party to a marriage) would be the one filing the lawsuit.
