    Out of the country.
    Is it legal for the father of my 2 sons to allow his girlfriend to leave the country going to Mexico without my consent.

    So... you want to know if the girlfriend needs your consent to leave the country? By herself? Is that the question? Is she taking your 2 sons?

    You have to make yourself more clear. It sounds like you are stating that his g/f is going on her own.

    I am assuming you mean, is it illegal for them both to leave the country with your two sons; yes it is even if it is shared custody. They have to have your consent to do so. And seeing as Mexico is a foreign country, then that would make a big difference, rather then state to state.

    Of course, you have re-state, is this what you mean because it certainly would not be illegal for his g/f to leave the country on her own.

    The sons will probably need a passport to get into Mexico. And to get back to the U.S. (You are in the U.S, right?) The OP will have to sign their passport application.

    So what you are basically saying is that the mother actually has to give permission by signing the passport application.

    1. who has custody ?
    2. does the father have visitation or joint custody ?
    3. are the kids going with the girlfriend ?
    4. Is the child's father going to Mexico too ?
    5. is it for a day, a month?

    Yes.

    "The minor and both parents (or guardians) must appear in person to submit Form DS-11 at an acceptance facility or a passport agency. " Minors Under Age 16
    (for minors under 16; minors 16 & 17 need not have their parents present to apply, but must "Establish parental consent (You may be requested to provide written parental consent for a child age 16 or 17 if it is not implied on the application)" And passports are required to go to Mexico now.)
