You say that it is too soon into your relationship to be getting this serious. Besides, in most places you have to be married for at least a year before a court will grant a step-parent adoption.

Well her birth father never signed her birth certifitcate so he was just wondering if he could just sign it

No, that would be illegal. It would be forgery of a legal document.

He would have to prove paternity to have his name placed on the birth certificate. He can't just "sign" it as the document is created at the Bureau of Vital Statistics (if you are in the US).

The birth father will have to have his rights terminated and a court of law will only do that if the child is being adopted.

I have to ask, though, why would you consider something this serious after only dating a man for 2 months? This is a recipe for disaster.

Is this the boyfriend that's going to PRISON?

Not the best role model for a father figure now is he?

He can not adopt since most areas require you to be married, and those few that don't, require a long term relationship, and this is normally informally considered at least a year.

In fact if you have only been dating a man for 2 months, he should barely be meeting the child at this point.

And no he can not just sign the birth certificate, that is fraud and a crime

It is highly doubtful that a judge will allow a prisoner to adopt a child while they are in prison.

As we have already told you... NO he cannot "sign" her birth certificate. That would be fraud and he would spend more time in the pen than he already is now.

Wow... your judgement is REALLY messed up.

Why would you stick your daughter with a legal connection to someone who breaks the law when YOU do not have a legal connection to that person? Are you willing to MARRY him? RIGHT NOW? If not, then why the HELL would you link your daughter to him legally for the rest of her life?

On top of that, you're asking if YOU should commit a crime and have him sign the birth certificate, when you KNOW it is a lie!

Just because your ex was good enough to have sex with but not good enough to have as your child's father doesn't mean you can deny your child the right to know their biological and medical history.

Get the BIOLOGICAL father on the birth certificate and get him to pay child support through the courts.
