Our landlord was granted an unlawful detainer against us, however we were never served. The landlord then came buy prior to the eviction being given and advised us that he was willing to work out something with us if were to surrender the keys, and we did so with the understanding that he was going to accept our money and allow us to open 4 days later. Well when the 4 days arrived he did not allow us to open. Now, he is refusing to give us access to the building to obtain our property, and is holding the liquor associated with my liqour license. Do you have any suggestions?

Did you get anything in writing? Do you owe him money?

No we did not receive anything in writing, however we have had numerious meetings to resolve the matter. Yes, we do owe him money.

Since this was, I assume, a commercial lease, the terms of the lease are paramount. What does the lease say about defaulting on rent?

That doesn't make any sense.

Why give him possession if you expected him to give it back to you four days later?

Why did he need the keys for just four days?

You have been played.

Yes he lied to you to make it easier for him,

You need to sue him in court, file for his detainer to be over turned due to no service. But it is very likely he can keep stock to cover money due at the time lease or rental ends.
