My ex is trying to claim child abuse on my part in court. I have spent a lot of money taking a lie detector test and having the police come over to inspect my home and interview my children. However, even though they found that I am innocent... because she went to the courts saying I did I have to prove this to them as well. Her lawyer is now trying to pull my PTSD diagnosed by the VA most likely to say I am an unfit parent. I have mild PTSD and have never experienced a black out and went through all my counseling with the VA. He is requesting my medical history which I don't know if I have to give it to him... and me having PTSD has nothing to do with why we are in court in the first place to make sure my kids are safe and to figure out where my son received this rash on his back from. I personally didn't notice it until the first night I had him when I gave him a bath. I contacted the mother immediately asking her if she knew... and now she is using this as a chance to try and take the kids from me.

If your question is whether all of your medical records can be subpoened, yes, they can.

How much weight will the Court put on them? Hard to say.

I wish I could afford an attorney... I am lost as to where to r I eceive help. I am just above the limit for legal aid... And do not have credit cards so have no clue how to proceed even getting one with nothing to give them. I am currently on supervised visitation as her doctors notes were inconclusive and the police. Had not finished their investigation so they pushed court back three weeks...

Keep in mind many rules have changed so you need to stay on top of the game. Medical records aren't so easy to get as they once were. Be sure to protect yourself.

If he has an attorney and you do not, the odds are against you and he has a much better chance of winning,
Just being right does not matter it is a legal game that if you don't know motions and laws it is easy to cheat you.

So please get an attorney.

If his attorney gets the judge to sign a order that requires them or you to provide those records then they can get them. I would not turn them over unless there is a court order.

It was not a request from the courts... just a request from the lawyer
