    Live in state of pa want to file bankrupt
    Live in state of pa and under new bankrupty law can garnish husband ssdi and our checking account since wife been on medical leave, and our only means of income since can't work. We also both have large amount of medical and credit card bills we can't pay.

    Your best, advice, will come from an experienced Bankruptcy Attorney who will review your assets and situations... and Bankruptcy Law. It's a Federal Law, by the way, not a State Law.

    If you file in Bankruptcy and your debts are discharged (eliminated) then there ARE no debts and no one can garnish anything. SSI can only be garnished for certain debts - student loans, child support, things along those lines.

    Your bank account at the moment is not safe and can be taken BUT your creditors have to get a Judgment against you first.

    Are there Judgments against either or both of you?

    My husband or myself do not have any judgement against us, but spoke with atterney with diablity law project who could not tell us if would take our money as jusgement to pay down debt. We were told it would necessary to file bankrupt because both have hugh medical bills and credit card debt. This would give us a better chance at getting another apartment if must move from our current and present apt. Yes I am very much afraid could take our money to pay down debt. Due to fact that I am not working and only live on hysband money cause for concern at this time. I was also told that need to reiew way could file backrupty see if qualify. Present time I am not sure what should do in our best interest

    If you wait until there is a Judgment your bank account could be levied. I would take action now.

    Again - in the vast majority of cases your benefits cannot be touched for credit card and/or medical debt.

    An Attorney would know - if you were not satisfied with the first Attorney, ask another.
