    No lease damage deposit
    I do not have a signed lease with my landlord and we are trying to get back our damage deposit. Can she keep it if we didn't give her a full 30 days notice?

    So are you planing on paying her the months rental from the 30 day notice that should be required ?

    Well there was never a lease signed so there was never anything drawn up as to terms of a notice that and part of why we moved was because we can't afford it (that's another topic in itself)

    Sorry, but it sounds like there is plenty of proof of a landlord/tenant relationship. Not having a signed lease isn't going to do it.

    You paid a deposit, I assume you paid a monthly rental. That is sufficient. Indiana law requires a 30 day written notice. Therefore, if you did not give proper notice, the landlord can withhold your deposit towards unpaid rental.
