    Garnishment of wages Georgia! No notification
    I received my paycheck yesterday and it seems that a creditor has received a default judgement on a credit card from 2002 closed charged off account. They took %25 :mad: of my wages and intend to do so for the next 4 months. By that time I will be living in a shelter. I know the law states that I should have received some notification of a court date or some sort.
    The Creditor stated, a sherrif delivered the document to my door in March of last year at my old apartment. During that time I was unemployed due to a layoff and a fulltime nontraditional student, being I didn't want to break my lease, I subleased the apartment to a classmates cousin from out of town, until my lease was up. That person shipped town,and I ended up paying my lease and late fees for the last month of my lease.

    Getting to the point shouldn't they require a signature, id or some sort?:confused:
    To prove that is was me whom the papers were handed too.

    Should I go to the courts and get a motion to move judgement?
    Because the credit card limit was only 300 dollare, They want $1700

    Please help.. taking baby steps to success.

    No GA allows a notice on debt to be left on your door if the home is lived in and the lease is in the persons name. (I used to serve paper in GA part time) Some notifications have to be in person but not all in GA.

    You can file a motion to set the judgement aside, but since it may have been a legal notice according to state law it is hard to say what they will do.

    But of course if they do, they will merely re-serve you and start the garnishment in a month or two.

    25 percent is the normal amount that is taken. And not wanting to sound smart, but it would have been a lot easier way back when to pay off the 300 now they have legal fees, late fees, interest, fees for sheriff to serve and more.
