    Can my brother still sign the birth certificate?
    Ok here is my explanation first. My brother is currently in jail I have custody of both his daughter and son. He was home for his sons birth and he signed the birth certificate, but when his daughter was born he was already incarcerated. He is still in jail, so my question is can he still sign the birth certificate even though he is in jail and his daughter is already 2 years old and if so how do I go about getting the paper work and sending it to him.

    If I were you, I would contact the NJ Bureau of Vital Statistics and Registration to find out exactly what needs to be done.

    By the way, the parents don't "sign the birth certificate", they sign other forms which are presented to the vital statistics agency in your state. That agency issues (signs) the BC.

    And where is the mother?

    But yes, he should be able to submit whatever forms necessary to acknowledge paternity from in jail. Was he married to the mother when the child was born?
