    Child Support after 18?
    My son lives in NY--wants nothing more to do with me. I Live in SC. What if anything, can I do to emancipate him? He stole from he when he lived with me, he manipulates everyone and plays his mother and I against each other. He has told 2 sources that as soon as the support hearing is finished, he is moving out and living apart from his mother. There has been a history of support hearings for years. I am tired and stressed--on medications for anxiety and depression.

    What does the Court Order say? In NY child support can be until age 21 unless the child is emancipated, isn't in school, some other circumstances. When he does move out, he's emancipated!

    Why has support been an ongoing issue?

    His behavior (good, bad, indifferent) does NOT impact your child support obligation, unfortunately.

    Where was the support order issued? What does it say about when support ends?

    The child quit school due to bringing in a knife and has not returned. Never graduated High School. He has a history of living with his mother, then me. He has lived with me twice. He came to live with me for 6 weeks in SC, didn't like our "rules" and is now living back in NY with his mother. He plans to move out, most likely to live with his grandmother right after the June support hearing. I have heard this from 2 sources. I feel helpless being in SC. I don't want to have
    To go to another hearing when he moves out.

    Wayne Co, NY. I realize support ends in NY at 21, but I know he will be moving out, probably with his grandmother, after the June support hearing. 2 reliable sources have told me that. I don't feel I should be paying his mother support when he will be moving out. It's just going to be one hearing after another.

    Correct NY law governs which extends support to 21. You would have to prove he is living on his own to get emancipation in terms of child support. You would then go to court to declare the support order ended.

    Child is 17, and has quit school. He plans to live with his grandmother right after the support hearing. If he keeps his mothers address, how willI be able to prove he is not living there?

    You hire an investigator. Happens ALL the time, usually when it's spousal support as long as the party doesn't live with anyone.
