I live in India and had applied for the Special Enrollment Examination with the IRS for furthering the Profession. IRS had no issues on a person taking the Exam in the US as it is given only in the US now. I had a confirmed appointment with the Prometric - who were the conductors of the Exam on behalf of the IRS. I spent over 2500 USD on my travel alone to reach the US and my whole trip cost me 10000 USD .
I was not able to take the examinations as Prometric had a technical error occurring when I was signing into and the error was not rectified and I was not able to take the examination at all. I spoke to Prometric and they promised to rectify as quickly as possible but they were not able to do the correction until the last day of the exam and there was no dates available too to my convenience and at the place I was in.
Though prometric has promised to refund the examination fees paid or transfer the same to the window in June 2007, will I be able to recover any damages towards my cost incurrerd to the trip to the US. If its not for the examination, I would not have taken the trip at all.
Can I proceed against prometric from india ? They have a branch here in Delhi, India.
If anyone can guide me , it would be great
