    Divorce by listing in paper
    I can't afford an attorney and would like to file for a divorce on my own, I don't know where my spouse is at? We have been separated for the last 9years, and I would like to list it in the news paper, anyone know how long it needs to be listed? And what it should say?

    Recorder's office will list the appropriate wording; in Indiana the posting time is 60 days. You can check with your city county's website for the time limit in your state

    ANY question on law needs to include your general locale as laws vary by area.

    You don't get divorced by a newspaper listing. You may have to use a newspaper to try and inform your husband about the divorce. But you still have to go through a court to get a divorce. Most states have no fault divorce laws so its not hard or expensive to get a divorce.

    Would you please give more details about this answer?

    To the best of my knowledge the publication has to be by Court order in a newspaper (with a minimum circulation) approved by the Court.

    I'm in NY. I couldn't just post a notice in a newspaper in PA.

    1. First you file a divorce petition in the court.

    2. Then you make diligent inquiry to do your very best to find and serve your husband. One method of searching which you should attempt, is an online search (here for example).

    3. Next, assuming step #2 has not worked, you file a motion with the court to allow you to serve by publication. I suggest that you get the form of notice to be published approved by the court before you actually publish.

    4. Your court rules will specify how long it needs to be published, how many days it needs to be printed, etc.

    5. If your husband fails to defend within so many days of the last publication date, you will be able to apply to default him, and proceed without him in the divorce process.
