Can you be charged with theft it is has been over three years since it happen

It depends on the state where you live and the amount of the theft. If it was a teeny tiny amount, they probably can't charge you after three years... But, if it was BIG BUCKS, then they probably can.

Yes, if it was 10 bucks from the cash register, or a shirt you shop lifted, most likely the SOL is over now. If you took a gun and robbed someone, almost for sure they still can.
