    Parental rights question.
    If you give up your parental rights on children you don't have custody of can cps take your children you do have custody of?

    No, and no. You CAN'T give up custody of your children, so the other ones are safe.

    First seldom can you "give up custody" of your children, unless it involves an adoption or the state taking them away from you.

    To "take" your other children there has to be a reason that CPS would be looking at you and they have to prove a danger or unfit condition

    My mother had guardianship of them then something happened and they were placed in fostercare. I volunitarily gave up my parental rights on those two children so if my mother was ever get them back she could adopt them. Can they take my two smaller children that live with me?

    My mom has had guardianship of them since 1998.

    Why did your mother have guardianship? Why do you think CPS might get involved? Need more info.
