I was awarded $ 4600 for injury in a car accident. According to my solicitor, but today I received the papperwork which says I was awrded $ 8000 less $ 800 for medicare and on the papperwork it was not my signiture . At no time I said my money could go in my solicitors account and I never agreed for my medicare and insurance papper work to go to his p.o box. As its signed ( not by me ) and when I went to collect the money the cheque was made out from him ,when I asked why he said that's how the insurance companys do it and I just said OK. Can I do anything about this?

What country are you located in (you mention both dollars and the term solicitor which indicates someplace other than the USA or the UK... Laws vary and it helps to know which countries laws will apply.

What do you want to do? Obviously, you had a contingency agreement with him, and he collected his share. How does that hurt you? If you think paperwork shouldn't have gone to his office, then you'll have to show where that hurt you too...

The issue here is that he was obviously working for you, and if you had not written him a check or paid him other wise, there was an agreement, if only verbal for him to get a percentage of the money.

And did you get all the money you thought you were to get ? And yes of course insurance and attorneys get their money first before you get yours. And yes it is common and almost always does the attorney get the check written to them and then they pay out to you and to others who are suppose to be paid.

I understand what happened.. I want to know how it HURT you. If you don't have measurable MONETARY damages, you can't sue. He may have done something wrong, but as long as you WEREN'T cheated, then you have NO damages, and can't do ANYTHING.
