In my apt water is leaking from the ceiling of upstairs toilet. Who has to attend it . We or the people who stay in upstairs or both jointly should do?

The landlord needs to attend to it. It may not be visible in the upstairs unit. In either case, the owner of the building is responsible for such repairs.

Who has to attend the leak?
We stay in 2nd floor of the apt which is our own flat and water is leaking from the 3rd floors toilet. They r also the owner of that apt. The drainage water is coming through our ceiling and it affects our fan etc.
    Who has to attend it?

In some non-US countries apartment means condo. The owner upstairs is totally responsible.

Not necessarily. Could be a problem with shared plumbing in which case the condo association is responsible.
