    Getting married, I'm full time student, fiancé supports me and my child...
    In the state of WV.

    My fiancé and I plan to be married this year. I have a son, and his father pays (little) child support. I am unemployed and enrolled in school full time; therefore, I provide no income and my fiancé supports us both with the help of my student loans. This may sound like a silly question, but can he claim my child and myself as a dependent on his taxes? I would think so, but I'm not sure.

    He can claim your son, and you will file jointly as a married couple.
    Your loans and lack of income, combined with his income, will reduce your taxes.
    (If your ex is erroneously claiming your son, the IRS will notice in about a year, so be prepared to prove that he lives with you.)

    Thank you! I thought so, but I wanted to seek the advice of someone more familiar with the situation to reassure me. There would be absolutely no problem proving he lives with me. Thanks again!
