    Dual status resident or resident?
    I am not sure whether I am a dual status resident despite reading the IRS website.

    Background:
    I arrived on September 17, 2005 in the USA, started working on September 19, 2005. I filled as nonresident (1040NR I believe) in 2005. I spent a week vacation in February 2006 in my homecountry. I have L1 Visa.

    I think I am a dual status resident for the tax year 2006 although my tax advisor told me I am resident. Dual status residency would be beneficial for me as I am an expatriate with additional non-US sourced income.

    Based on the information given, your adviser is correct. You are a resident for tax purposes.

    I agree! L-1 visaholders who stay longer than 183 days normally are treated as resident aliens.
