    How can I have non paying spouse evicted?
    We both own and are on the mortgage, but she has not paid since November of 2010. I have sent an email to her asking for some kind of help with the mortgage, and no answer giving. I left the house cause I could no longer stay there with her. I have continued to pay for the mortgage and a rent payment, but can no longer pay for both. How can I have her evicted if she can't pay me... If there is a way?

    It doesn't matter who is on the mortgage, what matters is who is on the deed. If she is on the deed you cannot have her evicted.

    You need to file for divorce so the house can be sold and the proceeds split. Or you can simply let it go to foreclosure.
