I was on H1 visa from Jan 1 2010 to April 20 2010, and then I went to India. And my wife was in India with my daughter.I am still working in India.
She was on H4 status till Nov 7 2009, then she went to India. Also my daughter is US citizen, born on April 29, 2009 and she also went with my wife on Nov 7 2009.So for year 2010, Can I file the tax married jointly or single.
And also can I claim my child as my dependent.

If you previously filed as a resident in 2009, then yes, you CAN file jointly with your wife as residents for the 2010 tax return.

Because your child is a U.S. citizen, she can be claimed as a dependent on the 2010 joint tax return as well.

You also need to submit a joint Residency Termination Statement.
