    How can we adopt our. Nephew from foster care?
    My fiance's sister hasn't seen him in a yr and half, so the courts terminated her rightss. They are going through with adoption. How can we get him? He is in another state than us. We want to keep him with family. PLEASE HELP!!

    Adoption regulations vary from state to state, but all states prefer having children adopted into stable and secure homes rather than placed in foster care.Each state has a different definition of "relative" and the degree of relatedness between the prospective adopter and adoptee.
    Having said you and your fiancée are still not married, ONLY your fiancée has rights to fight for adoption but he has to compete with some married couples.

    So the mother had her rights terminated? Are you sure? If it was done as part of a step parent adoption it is probably too late.

    I have no doubt about it was not step parent adoption.

    Thank you. We are to be married in 2 weeks. And the people wanting to adopt him is the foster parent.

    Out of curiosity---what have you done to remove him to foster care PRIOR to the news about the adoption? Did you try to have the child placed in your custody prior to this? How old is the child? How long has he been with these foster parents?

    His sister lost him for mental issues. She was given a list of things to complet before she got him back. It was tempary, until last month. He's been in foster for little over yr. and no we didn't try before now, since we thought she'd get him back. He is 5
