Ask Me Help Desk - How many eviction cases dismissed, denied due to c96-38, while property destroyed

HOW MANY Landlords have had their eviction cases dismissed or denied due to pleadings, after waiting through the process of 3 day and 5 day and time to evict, only in the end to be told, that no answer for the error in filing is given, or it was not the proper 3 day form, or due to C96-38, while their property was being destroyed by a non paying tenant that was in non compliance of their lease and was a threat to the property and property owner, also how many of these landlords have ever received one penny in restitution toward the court costs or damages?

I don't know, and what difference does it make? If it NEVER happened to anybody else, it happened to you. But, WE didn't advise you, so why are you so pissed off at us?

100s every week most likely which is why it is important for landlords to fully understand the laws of eviction and rental.
Also of course landlords lose millions from damages each year before they even know or the person is late one day.

Even following every rule, it is far too common for a landlord to visit his property to find holes in the walls, carpets all ruined and more. Even myself had one leave and take the fridge, store and air unit when they moved out all of a sudden and took everything.

And no seldom do you ever get any money, even after winning a judgement, most of the people doing this have no money and one never sees any money

Let me see, it appears you are complaining because a court followed the rules and you didn't. With the result that your tenants were allowed to hose you.

Well, if your action here are any example you seem too impatient to follow the rules and make sure all your Is are dotted and Ts crossed. You have broken two rules here:

I will point out that a) that thread was over 2 years old and b) the response you commented on did not give any advice, it merely thanked the OP for letting us know the advice worked for him. So your comment was nothing more than a continuation of your ranting about your own troubles, most likely caused by your own mistakes. It was not to correct any factual error in my post. As such it was against our rules as is reviving old threads.

As excon pointed out this happened to you. Maybe it happened because you didn't do your research and get advice from a site like this. But we don't make the laws, nor do we uphold them. We try to help both tenants and landlords become aware of their rights. For every landlord that was abused by a tenant, I'm sure you will find an equal number of tenants abused by landlords.

Why respond if you don't know, I would have not asked, if it did not make a difference, and I am not P O'd at you plural, I am only P O's at the ignorant unjust legalism that is causing property investors to become victims of a time consuming costly unjust legal system.

Thank you for your response, but I would like a real number of landlords, because I believe it is more like 1000's instead of 100's, but your response was helpful, because you are right, it is far too common and the final results are very unfair to the property investor.. Thank You for your honesty..

I am not P O'd, or frugal... I am like many property investors too broke after having my income and assets destroyed by non paying destructive tenants, and I am new to this website and did not realize it was a 2 year old thread. And your answer or comment does not answer my question at all..

Yes, I have more to say... If you want help, ask for help. We CAN help you, EVEN if you've been screwed before...

But, you didn't ask for help. You asked us to come up with some mythical number that's going to satisfy you, for some reason... You liked it when the Padre said 100's. In fact, I'd say it's in the MILLIONS. Does THAT make you feel better?? Does it help to know that you got screwed along with MILLIONS of other dupes?? It wouldn't make ME feel any better. The fact that I got screwed would be enough.

But then, when I go into business, I know what the RULES of the business I've chosen are... I mean, if you're going to play Monopoly, you should know the RULES of Monopoly, shouldn't you?? But, like the other million or so of you, you think you can buy a house, rent it, and retire... You don't EVEN consider that you're in a business and that it should be RUN like a business... Landlord/tenant law?? Nahhh... You don't need no stinkin landlord/tenant law...

Then, when you FAIL, as you inevitably WILL, you look for anybody to blame OTHER than yourself. The SYSTEM is wrong. Scottgem is wrong. I'm wrong. The country is wrong... The tenant is wrong...

But, the fact of the matter is, you lost your money because YOU were wrong. That's the way it is. Deal with it.

MR ScottGeM :I followed the rules, but the rules changed, at landlord legal form websites, a cure or quit notice is acceptable by law, the cure or quit notice was not accepted by judge, dept of agriculture & consumer affairs has landlord/ tenant statute 83, says other evictions, it says that if tenant is destroying property they can be given notice and some cases be made to move in 7 days or less, yet the clerk of courts give no option for a landlord to get them out in 7 days or less, instead they take the money to continue the filing 3 and 5 day notice and final judgement and writ and process fees, then after the whole month has expired they send it back dismissed while the destructive tenant is still remaining on the property destroying it... I did not know that the question I asked was on a 2 year old thread, I am a newcomer to this website, but what I have learned from your response is that your answer does not answer my question, is full of assumptions & concerned more with popularity ratings. I CAME INTO THIS WEBSITE LOOKING FOR ANSWERS EXACT NUMBERS OF VICTIMIZED PROPERTY INVESTORS, VICTIMIZED BY OUR UNJUST LEGAL SYSTEM, instead got a ranting response from you, who is more concerned as a computer expert with clicking you like yourself on a popularity rating number than the number you have beside your name in THE BOOK OF LIFE... maybe you should be more concerned with your rating there..

First, if you didn't notice that thread was over 2 years it its because you didn't look. The posts dates are very clearly displayed. Nor did you take the time to read the rules of this site to learn that your rating my question was inappropriate.

You are also wrong about this site. I will point out, again, that in the thread you posted on, the OP got advise that helped him solve his problem. Popularity has nothing to do with this site, we strive for high quality responses. I personally have no concern about popularity, my only concern is that I give high quality answers. And I let my record speak for itself. Your attempts to insult me (another violation of the rules of this site) fall on deaf ears because they have no basis in fact.

As to what you came to this site form, you seem to have a misunderstanding of how to use this site. I don't know of anyone that has done a survey of "victimized" property owners. I've done a search on that phrase and did not come up with any specific information. So I'm sorry if we can't answer your question, but the reason is the statistics you want probably do not exist.

What you can do, is purchase a list of landlords in your area (or get it free if you can) and send them a survey to see how many respond. You are looking for numbers so, since no one seems to have done such a survey you will have to do it yourself.

Finally, yes I did make some assumptions. But I have to to try and give you quality advice. I do not know all the facts surrounding your situation, because you have not given them. But you did indicate that part of the problem was technical errors in your submissions to the court. Based on that and your actions here where you didn't try to learn the rules, led to certain assumptions. That is the nature of a site like this.

I'm sorry if you did not find what you are looking for, but that seems to be more due to unrealistic expectations then any deficiency with this site. You came here, attacked me without basis and continue to argue with people willing to help you is you remain calm and civil. This doesn't inspire us to expend effort helping you.
