Can I have his rights revoked?
I have a 5 year old daughter, and my husband wants to adopt her. However, now her father has all of a sudden served me with papers wanting custody! He has told everyone since the day she was born how he does not want her, and the only reason he is doing this is so that his wife can try to control my child's life! We were planning on moving about 2k miles away, for a new life, to be closer to family, and for health reasons, but now don't know if we can even do that. I want to know if there is any way I can have his rights taken away since he has made no attempt to contact her in over 15 months?

You have to go to Court and let a Judge decide who should get custody and whether you can leave the area. Your new husband cannot adopt her without the written consent of the birth father.

Does the birth father pay child support? If not, why not?
