    My adult son
    My adult son who is 21, lives home... pays rent... but won't follow a few simple rules an when I tell him if he don't like it he can move out he says" I pay rent, n recieve mail here you want me out u have to go to the court an evict me" is this true?

    Yes, you would have to evict him - and that process varies by State.

    If he pays rent he is a co-tenant. And most landlord-tenant acts don't address the situation of one co-tenant evicting another co-tenant.

    Do you have a lease or are you month-to-month?

    It could be that you would have to move and leave him to deal with the landlord.

    Another guess on my part but I thought the mother owned the home, the son paid her rent... or not.

    Yes, could be. In which case he would be the sub-tenant. She would simply give him a notice to quit (normally 30 days), and then file in court for eviction.

    But you will have to evict him, you can not merely kick him out
