Query on F-1 status, CPT and related tax returns
    Dear Expert,

I came to USA in Sep 2009 on F-1 Visa from India and finished my education in Dec 2010 in the state of IL. From June 2010 to Dec 2010, I was doing an internship on CPT authorization in the same state. During this, my spouse was my dependent on F-2 visa. I also paid $22,156 as against my Tuition and Fees. My queries:

    * What all forms I need to fill for tax purpose? I heard of 1040NR, 8843 and 843. What else?
    * Will get any deduction based on the tuition that I paid in the same year? What documents I need to provide?
    * Will I get my Social Security and Medicare taxes returned? Which for do I need to fill?

I would appreciate if you can add some information to this and guide me.

    Thanks,
    Varun Pahade

Form 843 is required ONLY IF FICA (Social Security and Medicare) taxes were improperly withheld from your OPT/CPT salary and you could not get the refund from the employer.

You DO have to file Form 1040NR and 8843 for you annual tax return, plus the Indiana state tax return.

You will get NO education deduction or credit, as you are NOT eligible as a non-resident alien.

If you need professional help filing your return, email me at [email protected] or [email protected].
